Membership Terms and Conditions – The Inside Out® Community
We are delighted to welcome new members to our thriving network of in-house creative leaders. Our mission is to support you on every step of your in-house creative leadership journey. These Membership Terms and Conditions outline the framework for your membership, ensuring a clear and mutually beneficial experience within our supportive community.
1. Interpretation and Definitions
The following definitions apply in these Terms and Conditions:
- ‘The Community’ or ‘The Inside Out® Community’: The legal entity operating The Inside Out® Community.
- ‘Force Majeure’: Any event or occurrence which is outside the control of the party affected and which is not attributable to any act or failure to take preventive action by the party affected.
- ‘Intellectual Property’: Copyright, database rights, trademarks, patents, and other industrial or intellectual property.
- ‘Materials’: All materials including written content, newsletters, event materials, presentations, videos, website content, branding, logos, and other Community materials used by or relating to the Member Benefits.
- ‘Member’: A fully paid-up individual member of The Inside Out® Community.
- ‘Member Benefits’: The benefits provided by The Inside Out® Community for the benefit of Members subject to these Terms and Conditions.
- ‘Membership Term’: The 12-month period of valid membership commencing on payment.
- ‘Membership Criteria’: The specific criteria that applicants and members must meet to join and maintain membership in The Inside Out® Community. The most up-to-date version will be found on https://theinsideout.community/membership/faqs/
- Partners – external businesses or organisations which The Inside Out® Community works with, including on a commercial basis, which have been chosen for their relevance to the community and our members
- ‘Renewal Date’: The anniversary of the Commencement Date when membership is due for renewal.
2. Membership of The Inside Out® Community
- Membership provides you with access to our comprehensive Member Benefits, designed to support you on every step of your in-house creative leadership journey and help you navigate your career with clarity and purpose. These benefits are outlined in clause 5.
- The Inside Out® Community may offer different categories of membership with their own sets of Member Benefits, which will be detailed on our official website.
- Applicants for membership must satisfy The Inside Out® Community’s Membership Criteria, which will be specified by the The Inside Out® Community. Applications that do not meet these criteria will not be accepted.
- To ensure our community remains a focused and valuable space for in-house creative leaders, The Inside Out® Community carefully reviews all applications. We reserve the right to decline an application, to ensure members align with our Membership Criteria and contribute to the collective benefit of our members
3. Membership Term
Membership is valid for a period of 12 months from the date of payment of the membership fee unless otherwise agreed in writing, in advance. This period will start on the Commencement Date, unless otherwise stated in writing by the Community.
4. Membership Rights and Access to Benefits
- All Members will receive notice of member benefits and promotions and you may exercise your right to benefit from those included in your membership category. We may, at our discretion, offer additional benefits for purchase at Members’ rates.
- Individual subscriptions typically include rights for the individual member only. Our membership “Passport” option allows you to put forward a team member to replace you at any of our online events.
5. Member Benefits
The Inside Out® Community is dedicated to supporting you on your leadership journey by providing exceptional Member Benefits, which include our commitment to:
- Develop and support programmes of diverse events, training, coaching, mentoring, networking, and knowledge sharing, both in-person and/or online
- Evolve, adjust, and vary the range of member benefits, considering member feedback, level demand, and availability.
- Enable exclusive access to specially selected industry professionals in our Advisors.
- From time to time, undertake, promote, and make available research and information relevant to the community’s focus.
- Provide access to internal and external discounted member benefits, subject to relevant terms and conditions.
- Establish, develop, and maintain links with other bodies and organisations at local, national, and international levels.
- Maintain a membership database to confirm your membership status.
- Reserve the right to promote and sell certain member benefits, without member discounts, to non-members.
- Share communications from Partners and collaborators which may be of benefit to members
6. Membership Fees
Membership of The Inside Out® Community in each category and access to Member Benefits is conditional upon meeting the Prescribed Membership Criteria and the payment of the appropriate subscription fee. The Membership Fee is paid annually in advance. The Community reserves the right to update fees annually, and members will be notified in advance of any increases.
7. Renewal and Expiry of Membership
- The Inside Out® Community reserves the right, at our sole discretion, to vary pricing, benefits, and/or any other factor which enables us to continue to offer members benefits.
- Where any subscription payable by the Member to the Community is not paid by the Renewal Date, your membership will be deemed to have lapsed following a grace period of 28 days.
- During any such grace period, Members remain subject to The Inside Out® Community’s Terms and Conditions but access to any member benefits is at the sole discretion of The Inside Out® Community.
- At the expiry of the grace period, any membership for which fees have not been received in full will be terminated, and the Member will lose the right to all Member Benefits.
- Members who renew their membership reconfirm their acceptance of and continued compliance with these Terms and any associated rules and regulations.
8. Right to Cancel
Members shall have limited rights to cancel their membership.
- Members wishing to cancel their membership may do so within 14 days of payment. In such cases, a full refund may be given, potentially minus an administration fee.
- Beyond this cooling-off period, no refund is typically due if membership is cancelled prior to the end of the Subscription Period.
9. Membership Termination by The Inside Out® Community
- The Community may terminate a Member’s membership if the Member no longer meets the Membership Criteria. In such cases, the Member will be given notice and an opportunity to be heard before a final decision is made.
- Any Member who ceases to be a Member shall remain liable for all subscriptions and any other sums due from the Member up to and including the date when their membership ceases.
- The Inside Out® Community may immediately withdraw or suspend your membership or entitlement to Services if:
- In our sole opinion, you materially or repeatedly breach any of these Terms or fail to adhere to any associated rules.
- You fail to make any payment to the Community on the due date.
- You become ineligible to be a member for any reason.
- Should a membership need to be terminated due to a breach of these Terms or a change in Membership Criteria, access to Member Benefits will end. We respectfully request that individuals no longer represent themselves as members of The Inside Out® Community, to ensure clarity and integrity for all.
10. Membership Rejection and Reassessment
- An application for membership or for transfer between categories will be determined by The Inside Out® Community, which may, at our sole discretion, decline to accept an applicant.
- Members are advised that the Community may also, in certain circumstances, reassess the Membership category of any Member whose Membership was terminated or ended.
11. Intellectual Property Rights
- The Inside Out® Community and/or our content or service providers own all Intellectual Property (including copyright, designs, trademarks) which exists in the Materials provided to Members as part of the Member Benefits.
- Membership does not confer any right to use the Community’s Intellectual Property, except where expressly provided in writing.
- The Member shall not licence, sell, rent, lease, transfer, assign or otherwise commercially exploit Materials (including passwords) or Member Benefits to any third party.
- Members may generally state their membership on personal materials (e.g., business cards), but must not use The Inside Out® Community logo or branding without prior written consent, nor imply endorsement or authority where none exists. Members are entitled to use the digital badge provided
- A failure to comply with these Intellectual Property terms will constitute a material breach and may result in membership termination without refund.
12. Force Majeure
In the event of Force Majeure (any event or occurrence which is outside the control of the affected party and not attributable to their actions, e.g., natural disasters, pandemics), The Inside Out® Community shall not be deemed to be in breach of these Terms and Conditions. To the maximum extent permitted by law, all losses arising for this reason shall not be recoverable by the Member. The Community has the sole discretion to continue, suspend, or terminate memberships in such events.
13. Variation of Terms
At our absolute discretion, The Inside Out® Community may at any time alter, amend, change, modify or withdraw any of the membership benefits that comprise the membership offering. It will be your responsibility to keep up-to-date with all such changes, and your membership renewal and continued use of the Member Benefits will be deemed acceptance of any changes to these Terms and Conditions. The Community will typically inform members of material changes via email and/or the website.
14. Notice and Communication
Any notice to be given under these Terms and Conditions shall be in writing, which shall include electronic communication to the email address you provide. As a Member it is your responsibility to keep your personal details updated.
15. Data Protection
By accepting these Terms and Conditions, you agree to the use of your information as set out in The Inside Out® Community’s Privacy Policy and to being contacted by the Community and our partners in relation to future events or other membership benefits via email and newsletter. Personal data will be collected, stored, and used as prescribed in the Privacy Policy.
16. Liability
- The Inside Out® Community typically has no liability for any loss of profit, loss of business, business interruption, or loss of business opportunity arising from your membership.
- The Community is generally not responsible for unforeseeable loss or damage, or loss/damage arising from your misuse of the website or services.
- Nothing in these Terms shall exclude or limit liability where it would be unlawful to do so, such as liability for death or personal injury caused by negligence, or for fraud.
- The total liability of The Inside Out® Community to you, whether in contract, tort, negligence, or otherwise, in connection with your membership, is typically limited to the value of your Membership Fee.
17. Governing Law and Jurisdiction
These Terms and Conditions shall be interpreted in accordance with English law, and all disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
